Acts of Discrimination and Retaliation
Because Virginia is an "at-will" employment state, employers generally have the right to terminate an employee at any time, for any reason, or for no reason at all. This right, however, is not unlimited. State and federal laws prohibit employers from taking certain adverse action against employees, such as for discriminatory or retaliatory reasons based on protected characteristics (e.g., race, gender, age, religion, national origin, disability, or pregnancy), or for requesting or taking protected leave (e.g., the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA)).
