Melissa A. Hamann

Attorney

Melissa Hamann is an experienced employment lawyer and litigator. She has significant experience advising employers and employees in all aspects of employment law as well as representing clients in federal and state court and before administrative agencies.  She has been recognized as a “Top Lawyer” in Employment Law in Coastal Virginia and was awarded a Public Service Award by the City of Chesapeake for her representation of the City’s Human Resources Department.

For Employers:

 

Melissa regularly advises employers on wage and hour compliance, worker classification, employee leave and accommodation issues, and discipline and discharge matters. Additionally, she assists employers by drafting and reviewing employment agreements, restrictive covenants, employee handbooks, and other workplace policies and procedures. She also advises government contractor employers on Davis-Bacon and Service Contract Act requirements related to certified payrolls, prevailing wages, and related compliance reviews.

For Employees:

 

Melissa regularly advises employees on employment agreements and restrictive covenants, compensation issues, discipline and discharge, and workplace discrimination and harassment.  Her practice includes assisting federal employees with EEO complaints and investigations.

Litigation and Administrative Hearings:

Melissa has significant experience advising and representing clients in cases arising under Title VII of the Civil Rights Act, the Fair Labor Standards Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, and other federal and state laws, to include cases concerning breach of contract, violation and enforcement of non-competes and other restrictive covenants, and defamation. She represents clients in federal and state court and before administrative agencies, such as the Equal Employment Opportunity Commission and the Office of Civil Rights. She also represents clients in grievances, mediations, and arbitrations.

Prior to beginning her legal career, Melissa served five years on active duty in the U.S. Navy as a Surface Warfare Officer with a nuclear engineering specialty.
